1. Acceptance of Terms

By downloading, installing, accessing, or using the Clocked mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and Foldup Studio (“Company,” “we,” “us,” or “our”).

2. Description of Service

Clocked is a race timing application designed to help users time races, track participants, manage groups, record lap times, and generate race results. The App provides tools for creating and managing racing groups, timing individual and group races, recording lap times and statistics, generating reports, and exporting data.

3. Eligibility

You must be at least 13 years old to use this App. If you are under 18, you represent that you have obtained parental or guardian consent.

4. User Responsibilities

You are responsible for ensuring all information you provide is accurate and up-to-date. You are responsible for maintaining the security of your device and any data stored within the App.

5. Acceptable Use

You may use the App for personal, educational, or commercial race timing purposes. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels

6. Data and Privacy

Data is primarily stored locally on your device. We do not automatically collect or transmit your race data to external servers unless you explicitly choose to share or export it. You control how your data is shared through the App's export features. Please also review our Privacy Policy.

7. Intellectual Property

The App, including its design, functionality, code, and content, is owned by Foldup Studio and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. You retain ownership of any data you input into the App.

8. Disclaimers

While we strive for accuracy, we do not guarantee that timing functions will be 100% precise. Race timing can be affected by device performance, user error, and environmental factors. The App is provided “as is” and “as available” without warranties of any kind.

9. Limitation of Liability

To the maximum extent permitted by law, Foldup Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

You acknowledge that timing sports events carries inherent risks. You assume full responsibility for the safety of all participants in events you time using the App.

10. Indemnification

You agree to indemnify and hold harmless Foldup Studio from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or any race timing activities conducted using the App.

11. Updates and Modifications

We may release updates and reserve the right to modify these Terms at any time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance of the new Terms.

12. Termination

You may stop using the App at any time by uninstalling it. We may terminate or suspend your access immediately if you breach these Terms. Upon termination, data stored locally on your device will remain until you delete the App.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. If any provision is found to be unenforceable, the remaining Terms remain in full effect.
