1. Acceptance of Terms
By downloading, installing, accessing, or using the Clocked mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Foldup Studio (“Company,” “we,” “us,” or “our”), the developer of Clocked.

2. Description of Service
Clocked is a race timing application designed to help users time races, track participants, manage groups, record lap times, and generate race results. The App provides tools for:

• Creating and managing racing groups and participants
• Timing individual and group races
• Recording lap times and race statistics
• Generating race reports and statistics
• Exporting race data in various formats

3. Eligibility
You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.
4. User Account and Registration
4.1 Account Creation
While the App may function without requiring account creation, certain features may require you to provide information such as:

• Participant names and details
• Group information
• Race data

4.2 Accuracy of Information
You are responsible for ensuring that all information you provide is accurate, complete, and up-to-date. You agree to update your information as necessary to maintain its accuracy.

4.3 Account Security
You are responsible for maintaining the security of your device and any data stored within the App.

5. Acceptable Use
5.1 Permitted Use
You may use the App for personal, educational, or commercial race timing purposes in accordance with these Terms.
5.2 Prohibited Activities
You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App’s functionality
• Use the App to collect or harvest information about other users without consent
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices or labels
• Use the App in any way that could damage, disable, or impair the service

6. Data and Privacy
6.1 Data Collection
The App may collect and store:
– Race timing data
– Participant information (names, statistics)
– Group and race configuration data
– Device performance data for app optimization
6.2 Data Storage
Data is primarily stored locally on your device. We do not automatically collect or transmit your race data to external servers unless you explicitly choose to share or export it.
6.3 Data Sharing
You control how your data is shared. The App provides export features that allow you to share race results as you choose. We do not share your personal data with third parties without your consent, except as required by law.
6.4 Data Retention
You can delete race data at any time through the App’s interface. Uninstalling the App will remove all locally stored data.

7. Intellectual Property Rights
7.1 App Ownership
The App, including its design, functionality, code, and content, is owned by Foldup Studio and is protected by copyright, trademark, and other intellectual property laws.
7.2 License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose, subject to these Terms.
7.3 User-Generated Content
You retain ownership of any data you input into the App (race results, participant information, etc.). By using the App, you grant us a limited license to process this data solely for the purpose of providing the App’s functionality.

8. Disclaimers and Limitations
8.1 Accuracy Disclaimer
While we strive for accuracy, we do not guarantee that the App’s timing functions will be 100% precise. Race timing can be affected by device performance, user error, and environmental factors.
8.2 “As Is” Service
The App is provided “as is” and “as available” without warranties of any kind, either express or implied.
8.3 No Warranty
We do not warrant that:
– The App will meet your specific requirements
– The App will be uninterrupted, timely, secure, or error-free
– The results obtained from using the App will be accurate or reliable
– Any errors in the App will be corrected

9. Limitation of Liability
9.1 General Limitation
To the maximum extent permitted by applicable law, Foldup Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
– Loss of profits, revenue, or data
– Business interruption
– Personal injury or property damage
– Errors in race timing or results
9.2 Maximum Liability
Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App (if any) in the twelve (12) months preceding the claim.
9.3 Sports and Athletic Activities
You acknowledge that timing sports and athletic events carries inherent risks. You assume full responsibility for the safety and well-being of all participants in any events you time using the App.

10. Indemnification
You agree to indemnify, defend, and hold harmless Foldup Studio from and against any and all claims and expenses arising from your use of the App.

11. Updates and Modifications
11.1 App Updates
We may release updates to improve functionality, fix bugs, or add new features.
11.2 Terms Updates
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or other reasonable means.

 12. Termination
12.1 Termination by You
You may stop using the App at any time by uninstalling it.
12.2 Termination by Us
We may terminate your access immediately if you breach these Terms.
12.3 Effect of Termination
Upon termination, your right to use the App will cease. Local data will remain until deleted by you.

13. Third-Party Services
The App may link to third-party websites or services. We are not responsible for their practices.

14. Export Controls
You agree to comply with all applicable export and import laws and regulations.

15. Governing Law and Dispute Resolution
